Our Objective
Our objective is to offer you the very most for your items and get you paid in the fastest amount of time. We do this by providing you with the highest standards of service and by processing your items within 24 hours of receiving your items in our processing department.
Terms, Acceptance, and General Provisions
In the Terms and Conditions set forth below, the terms "customer", "your", and "you" refer to the person or persons sending gold, platinum, coins and silver jewelry, or other precious metals (hereinafter referred to as "Items") to GSFC, LLC (Gold Stash) for sale and purchase (hereinafter referred to as "Transaction"). "We", "us, and "our" refer to GSFC, LLC (Gold Stash) and its successors and assigns.
In order to do business and conduct your transaction with us, you must accept the Terms and Conditions set forth below. You agree and accept the terms and conditions set forth below in their entirety by clicking "Register your Package" at the end of the Gold Stash request form.
Customers must be at least 18 years of age in order to sell precious metals or jewelry to GSFC, LLC. In addition, every customer of ours must be the actual legal owner of any and all gold, jewelry, and other property sold to GSFC, LLC, and every customer must be acting on his or her own behalf and not as another's agent or representative of another person. Your items must be free of any and all claims, liens, or anything else that might adversely affect the value of your items or your abilities to sell it to us.
Properly Describing your Items
Customers agree to list all items accurately on the enclosed Gold Stash Packing Slip that you received or printed. In our sole discretion, if we determine that there are significant discrepancies between the items as described on your Gold Stash Return Gold Mailing Bag and the items we receive, or if no Gold Mailing Bag was included in the package, we may suspend or terminate the Transaction with notice to you. In the event that we terminate the Transaction, we will ship your items back to you within 2 business days at our cost and with the shipping method of our choosing, and you agree that we will only be responsible for insuring the value of your items up to $100.
Inbound Shipping Methods, Costs, Insurance
You can select one of the following inbound shipping methods:
FedEx® 2 DAY shipping provided free by GSFC
You may print your own air bill, packing slip, and instructions from our website or we will mail you all the shipping packaging materials at our expense. If you choose this method of shipping and use a FedEx® shipping label provided by us, we will pay your inbound shipping costs, including insurance up to $1,000 with FedEx® and should your items become lost in transit, we will file a claim with FedEx® and pay you the value of any settlement received from FedEx® up to $1,000. If you believe that you need additional insurance, then it is your responsibility to obtain such additional insurance at your expense before sending us your merchandise. You can contact us by telephone (1-877-800-1077) to arrange for additional insurance or shipping instructions.
Ship it yourself option:
You can choose to ship your items at your own risk and expense. If you choose to ship it yourself or choose not to use a FedEx® air bill provided by us in any event, you agree to pay for all inbound shipping expenses, to insure your merchandise at your own cost for full value with the shipper, arrange for package tracking, and waive any and all claims against us for any loss or damage to the merchandise during transit. Any claims for lost or destroyed merchandise must be made against the shipper – not us.
Receipt of Items
We reserve the right, in our sole discretion and with notice to you, to reject any inbound mail, envelope or package which appears to have been tampered with prior to delivery and it will be returned to the customer. According to these terms and conditions, any inbound package that we reject will not be deemed to have been "received" by GSFC, LLC.
Method of Payment
There are two ways to choose to be paid. A-Standard payment which is paid via check and is mailed to customer via USPS first class. B- RAPID CASH option at no additional charge and GSFC, LLC will wire funds directly to customer's checking account. Checking account must be the owner of the items, no exceptions. If customer selects the rapid cash option, the customer will need to provide a voided check at the time of mailing jewelry to us. By selecting the rapid cash option, the customer waives the fourteen (14) day customer satisfaction holding/return guaranty.
After receiving and processing your items we will either (1) mail check via USPS for accepted items or wire payment for accepted items (if a customer selects the rapid cash option) and/or (2) return jewelry that is not accepted (gold plated, silver plated, or costume jewelry). We will issue payment within twenty-four (24) hours of receiving and evaluating customer's jewelry.
Fourteen Day Customer Satisfaction Holding/Return Guaranty
We will hold customer's items for a period of fourteen (14) calendar days after mailing the check to you. This only applies if you have utilized our standard payment option. If
however, customer selects our rapid cash option, the customer waives the
fourteen (14) day holding/return guaranty.
In the case of the standard
payment option, if you choose not to sell your items for any reason, you
are required to notify us immediately by email. If we do not receive
your request to return your items via email to
processing@goldstashforcash.com within fourteen (14) calendar days from the date listed
on the check, your items will be processed.
You must return the un-cashed check we issued at your own expense before we can return the items. Once you have met these requirements we will quickly return your items. Failure to complete these requirements will result in final sale of your items. Furthermore, the cashing of the GSFC check at any time within the 14 days constitutes final and immediate sale, removing the
(14) day holding/return guaranty.
Electronic Signature
For purposes of the transaction, you hereby agree to the use of electronic signatures, receipt of notices by e-mail, use of electronic contracts and to accept these terms and conditions by electronic means. You agree and accept the terms and conditions set forth below in their entirety by clicking "Register your Package" at the end of the Gold Stash request form.
Returned Items
In the case where your items are returned to you as outlined in these terms and conditions; we will ship the items to the address that appears in our records via the shipping method of our choosing and at our expense. We will insure the items for the full value of the rejected settlement. If the package is lost while being delivered to you we will file a claim with the company we sent it with and pay you the full value of the rejected settlement.
Limitation of Liability
In any and all events or situations outlined in our terms and conditions you agree that legal limit of our responsibility/liability to you for any and all claims/actions which include lost, damaged, or destroyed merchandise shall not exceed the lesser of our settlement to you or $1,000 per transaction. You agree that we will not be liable for incidental, special, indirect, consequential, or punitive damages or loss of profit or opportunity, claims, demands, or actions for any subrogation claim brought by your insurance carrier and you expressly and specifically waive any subrogation claim on your behalf as well as on behalf of your insurance carrier.
Effective Date
To better service our customers we have updated our terms and conditions as of March 1st, 2010. The previously posted terms and conditions apply to all packages sent to us prior to March 1, 2010. You can request a copy of our previously posted terms and conditions for transactions prior to March 1st, 2010 by emailing us at contact@goldstashforcash.com.
Miscellaneous
You agree that you provided to us your accurate email address, physical address, and telephone numbers and that it is your responsibility to provide us with any current or updated contact information. You further agree that: (a) any email message that we send to you is deemed to have been effectively received by you and constitutes due notice to you by email; and (b) any phone message we leave with you, anyone answering your phone, or on your answering machine or service is effectively received by you and constitutes due notice to you by telephone.
In the event of any strike, disruption of service, or any other problems that we might encounter with USPS or FedEx®, we reserve the right in our discretion to replace USPS or FedEx® with another shipping carrier.
GSFC LLC is licensed to do business in the State of Arizona and is governed by the laws of the State of Arizona. YOU EXPRESSLY AGREE THAT ANY CLAIMS, LAWSUITS, ACTIONS, OR DISPUTES AGAINST GSFC, LLC/GOLD STASH MUST BE EXCLUSIVELY FILED AND TAKE PLACE IN THE STATE OR FEDERAL COURTS LOCATED IN MARICOPA COUNTY ARIZONA, USA and you expressly agree that any such Court has personal jurisdiction over you. You waive all defenses of lack of personal jurisdiction and forum non-conveniens.
The fourteen day customer satisfaction holding/return guaranty refers to calendar days. All other references to days shall refer to business days. Saturdays, Sundays, and federal legal holidays are not included as business days, and if the expiration of any time frame set forth above falls on a Saturday, Sunday, or federal legal holiday, performance will be due on the next business day. Merchandise received after 2:00 p.m., or on any Saturday, Sunday, or federal legal holiday will be considered to have been received on the next business day. All business days will begin at 8:00 a.m. and end at 5:00 p.m. in Arizona on the appropriate day.
Notwithstanding any other provision herein to the contrary, we reserve the right to suspend or enlarge any time frame specified above, and/or request additional documents such as proof that goods were mailed or information from you, in order to comply with any applicable local, state, or federal law, ordinance, or regulation. Furthermore, any time frame set forth above may be suspended or extended in our discretion with or without notice to you in the event that we encounter technical difficulties concerning our website or otherwise, or encounter any other delays attributable to acts of God, including but not limited to fires, hurricanes and or other events.
